PennEngineering® Wins Preliminary Injunction Against Three Patent and Trademark Infringers

PennEngineering® has obtained a preliminary injunction against three patent and trademark infringers (collectively “Pemco”): Pemco Hardware Inc., Dongguan Fenggang Pemco Hardware Factory, and Shenzhen Pemco Fastening Systems Co., Ltd. (China). In addition to being restrained from commercializing the infringing products and being ordered to remove the infringing content from its website, Pemco was ordered to transfer ownership of multiple infringing domain names to PennEngineering. As a result, Pemco shut down its entire U.S.-based website.
The original complaint was filed against Pemco in November 2015. The complaint alleged patent infringement, trademark infringement, false designation of origin, counterfeiting, and trademark dilution under U.S. law, along with common law trademark infringement and unfair competition. PennEngineering alleged that a total of 12 of patents and trademarks were being infringed.
According to Mark Petty, President of PennEngineering, the lawsuit was filed to protect its intellectual property rights, as PennEngineering invests heavily in innovation and has built a strong reputation for its quality brands and leading-edge products. As in the past, PennEngineering will continue to enforce its intellectual property rights worldwide.
